OPELIKA, AL (WTVM) - A former sheriff's deputy is out on bond, after he turned himself in for a murder charge dating back to September of 2008.
The Lee County Sheriff's office tell News Leader 9, the case against Smiths Station resident, Mike Britton, will go before a grand jury.
Investigators say 57-year-old shot and killed 32-year-old Brian Hurst in 2008, after Hurst and Britton's daughter got into an argument.
A Lee County grand jury originally decided not to go forward with the case. But since then, new information surfaced thus prompting a grand jury to indict Britton last week.
