Columbus murder suspect wants bond

COLUMBUS, GA (WTVM) -  Twenty-two-year-old Dustin Horton is charged with murder after an alleged scuffle outside of a North Columbus Waffle House back in June.

Now, his lawyer is fighting to get him out of jail on bond.

Police say Horton "sucker-punched" 36-year-old Scott Drago outside of the restaurant on Veterans Parkway. Drago reportedly fell to the pavement, hit his head and died hours later at the Medical Center.

A prosecutor in the case says Horton "was in a fighting mood that night" and even made a statement on his MySpace page saying he's "been known to knock people out."

Horton's lawyer says he has no prior felonies and is not a violent person.

A judge did not give him bond Friday, saying he considers Horton a flight risk since he reportedly left the scene and went to Alabama the night of the crime.

The issue may come up in another 60 days if the case isn't indicted by then.
