COLUMBUS, GA (WTVM) -  Twenty-two-year-old Dustin Horton from Seale, AL has been indicted by a Muscogee Grand Jury on a felony murder charge.

In court documents, it says Horton caused the death of 36-year-old Scott Drago, a former Lee County Sheriff's deputy, by striking him with his fist back in June.

Columbus Police say Horton sucker-punched Drago outside the Waffle House on Veterans Parkway.

Drago then fell to the pavement, hit his head, fracturing his skull, and died hours later.

Next up for Horton is arraignment on December 4th.
