Motion to preserve evidence filed in Carlton Gary case

COLUMBUS, GA (WTVM) -  The attorney representing Carlton Gary has filed a motion asking a judge to order the preservation of evidence from the 1970s killing of several elderly women.

Gary was scheduled to die by lethal injection last month, but just hours before the sentence was to be carried out, a stay of execution was granted by the Georgia State Supreme Court.

It mandated a hearing in Muscogee County Superior Court about potential DNA testing of evidence collected from the crime scenes.

That hearing is set for February 1st.
