Carlton Gary update: Judge issues another order

COLUMBUS, GA (WTVM) – News Leader 9 is following all updates in the Carlton Gary case.

Judge Robert Johnston issued another order Thursday, requesting the Georgia Department of Corrections to bring the so-called,  "Stocking Strangler", to Columbus for a February 1st hearing.

The hearing will determine if DNA can be tested. In addition, to the examination of DNA evidence requested in the upcoming February 1st hearing, the District Attorney will examine whether or not the testing is enough to acquit Gary of charges or determine if it is the defense's maneuver to delay execution.

Gary was scheduled to die by lethal injection in December of 2009, but hours before the execution was carried out, a stay was granted.

The Georgia Supreme Court mandated a hearing in Muscogee County Superior Court about potential DNA testing of evidence collected from the crime scenes.
