Alleged rapist of 90-year old testifies in rape trial

LEE COUNTY, AL (WTVM) Closing arguments are set to begin Wednesday in the Anthony Vines rape trial. Vines is accused of raping a 90-year old Opelika woman back in November of 2008. The first trial ended in a hung jury.

The alleged victim, 91-year old Annie Hilyer, testified the defendant broke into her home, drug her back to the bedroom and raped her. Detectives testified the chain lock on her door was broken. The emergency room doctor who treated Hilyer testified her injuries were consistent with a brutal rape.

A DNA expert testified semen in the sexual assault kit done on the then 90 year old woman belonged to the defendant, Anthony Vines.

However, late Tuesday afternoon Vines took the stand and told a different story. He testified earlier in the week Hilyer invited him over to her home to do some work. He claims that morning she let him in, invited him back to the bedroom and initiated a sexual encounter.

"She was playing with her gown, I asked her how old she was, she said don't worry, then started the sex," Vines testified.

In cross examination, the prosecution was quick to ask how the chain lock had been broken. Vines said as he was opening the door when Hilyer fell down, causing him to jerk and break the door chain. The prosecutor also asked Vines why he had originally lied to police about his whereabouts that day. In his original statement to police Vines denied being at Hilyers house the day she was allegedly attacked. Tuesday he told they jury he felt intimidated by police and that's why he originally lied about his whereabouts. Plus, he did not want his girlfriend to get mad that he had sex with another woman.

Closing arguments are set to being first thing Wednesday morning, then it goes to a jury. News Leader 9 will continue to be in the courtroom for the case.
