COLUMBUS, GA (WXTX) – Fox 54 has confirmed the state has denied the motion to dismiss Michael Curry's indictment.
One of the defense team's motions claimed due process of law was violated under the sixth amendment.
Curry is accused killing his wife and small children with an ax back in the 1980s.
Early last month, defense team filed several motions in the case.
One motion alleged Curry's bible is being illegally withheld and was obtained without a search warrant. (Curry motion to return Bible and Sunday School notes)
Second motion requests contact information be made available for a potential witness. (Curry motion to receive witness contact information)
