Stocking Strangler's hearing postponed

COLUMBUS, GA (WTVM) - The man dubbed the "Stocking Strangler" will not appear in court today.  The motion hearing was postponed because defense attorneys cannot travel to Columbus due to the wintry blast in Atlanta.

Judge Land rescheduled the hearing for Wednesday, January 19th at 11:00 a.m. at the federal building on 12th street.

Gary's attorneys are seeking compensation from the federal court as they work on a motion for a new trial. Their argument is based on recent DNA results that showed semen collected at one of the infamous 1970's serial killings came from someone else.

DNA testing was not available when Gary was convicted of 3 of the 7 cases during the 1980's.  A judge ordered forensic testing last year.

Columbus District Attorney Julia Slater said four pieces of evidence were tested.  One test came back as a positive match to Gary. 

Slater said DNA found in a vaginal test from Jean Dimenstein was consistent with Gary's DNA.  Dimenstein's case was among the 4 murders in which Gary was not convicted.

Last month, Judge Land denied a related request from the lawyers.
