Spencer student charged in "sexual misconduct" case

COLUMBUS, GA (WTVM) -  A 17-year-old Spencer High School student turned himself in to police Thursday.

Daine Ashe is charged with statutory rape in what Columbus Police officials are calling a "sexual misconduct" case.

Investigators say Ashe had sex with a 14-year-old girl in the weight room inside the high school off of Victory Drive last week.

The case is still under investigation but police say the charge refers to consensual sex.

It was originally reported that the girl was raped by two or three male students.

The charge of statutory rape is a misdemeanor. Under Georgia law, if the victim and suspect are within four years of one another and the suspect is under 18, the charge is not a felony charge of rape.

Ashe was booked in the Muscogee County Jail Thursday afternoon.

Police say DNA results are still pending in the case.

Ashe is scheduled to appear in court Saturday morning in Columbus.
