Hearing set in Auburn tree-poisoning case

OPELIKA, Ala. (AP) - A Lee County district judge has set a preliminary hearing in April for the Dadeville man accused of poisoning the Toomer's Corner oaks at Auburn University.

Harvey A. Updyke Jr. is scheduled to appear in court at 9 a.m. on April 20 before District Court Judge Russell K. Bush.

Updyke's attorney, Glennon F. Threatt Jr., filed a motion for the hearing Wednesday.

The 62-year-old Updyke is charged with criminal mischief.

Auburn University removed the contaminated soil from the trees' roots as part of an effort to save the landmark oaks. On Tuesday, the university also began digging a series of test wells around the trees to track the spread of the poison.
