GA Stocking Strangler case subpoena approved

COLUMBUS, GA (AP) - A judge in Columbus has ruled that attorneys for Carlton Gary will be allowed to subpoena evidence from a 1977 rape that investigators believe was a precursor of 7 stranglings.

Superior Court Judge Frank Jordan Jr. reserved a decision on whether any evidence from the Sept. 11, 1977, rape and aggravated assault on a 64-year-old woman will be submitted for DNA testing to see if it matches Gary.

The woman identified Gary as her attacker during his 1986 trial.

The 60-year-old Gary was convicted of 3 of the so-called "Stocking Strangler" killings that took place in 1978 and 1979 and was sentenced to death. DNA tests performed in 2010 failed to match Gary to 1 of the victims.
