Arthur Sumbry, Sr. prepares for Sumbry Mortuary hearing

COLUMBUS, GA (WXTX) - We first broke the news about the foreclosure of a funeral home, owned by a Phenix City Councilman, just a few days ago. We also introduced you to some residents who were helping raise money for the funeral home. Now residents are speaking out on owner Arthur Sumbry Sr.'s behalf, while his attorney also weighs in on the upcoming hearing for Sumbry Mortuary.

Phenix City Councilman Arthur Sumbry Senior already had his first appearance in court for his upcoming trial on felony perjury and forgery charges. Now the Phenix City Mayor Pro Tem is preparing to go before a judge again to get his foreclosed funeral home back.

Sumbry Mortuary's attorney, Wesley Pitters, spoke to reporters via cell phone saying, "We believe that the court till find the actions by local Synovus Bank were unfortunate and will identify to the court as pretense."

Pitters says he believes the loan process was manipulated against Arthur Sumbry and the contract he had with the bank was breached, "There were some allegations against Mr. Sumbry about notes or loans he signed that were never received. The funds that were allegedly made on this loan, we believe there were several acts of irregularity."

When the hearing between Sumbry and Synovus is held, Pitters adds his client will be asking to overturn the foreclosure and Sumbry will be suing for damages.

But until that hearing, Phenix City residents are raising money, offering their support, and praying for their beloved funeral home.

"It's an outrage what has happened to Mr. Sumbry and his family. He's a well-respected councilman, and a well-respected citizen in our community that we all love," Sumbry family friend Nimrod Stephens told News Leader Nine.

The Sumbry vs. Synovus hearing will take place on August 8th in Russell County Circuit Court, however, a judge from another county has been appointed to the case. Until Sumbry gets the funeral home put back into his name, he is not supposed to use the property on Seale Road.
