Judge delays trial in Auburn tree poisoning

AUBURN, Ala (WTVM) - News Leader 9 has learned a judge has delayed the trial for Harvey Updyke, the man accused of poisoning the historic twin oaks at Toomer's Corner.

An order issued Thursday says the trial is being postponed at the agreement of both prosecutors and the defense.

News Leader 9 had reported that a delay was likely and Thursday it became official.

While Updyke's trial was set for this summer, officials say he probably won't go on trial now before November, or the middle of football season.

Updyke was arrested after making a call to the Paul Finebaum radio show and claiming he put herbicide around the bases of the Toomer's oaks.
