Lee County judge denies motion to step down

AUBURN, AL (WTVM) - The judge in the Toomer's Oak poisoning has denied a lawyer's motion asking he step down due to ties to Auburn University.

Lee County Judge Jacob Walker ruled Everett Wess did not provide enough evidence to show he was partial to the school.

Wess is representing Harvey Updyke Jr. on charges he poisoned the famous landmark.

Uptake, who has pleaded not guilty, will go on trial March 5.
