Delays surrounding Arthur Sumbry Sr.'s perjury and forgery trial

The case against Phenix City Mayor pro-tem Arthur Sumbry Sr. has been pending for more than a year now, and more setbacks on Friday could delay the perjury and forgery case even more.

Monday morning, Phenix City council member Arthur Sumbry Sr. is slated to walk in the doors of the Russell County courthouse, and stand trial for forgery and perjury, but that all has changed now.

In January 2011 Sumbry turned himself in to the Russell County Sheriff's Office after a grand jury indicted him for falsifying documents and lying under oath in relation to notarized paperwork. In August of that year a pre-trial hearing was held. In that hearing his attorneys requested that no mention be made of a previous charge and conviction Arthur Sumbry faced in 1981 for perjury.

His attorney Raymond Jackson told News Leader 9 in an earlier interview, "I would disagree with the allegations that those charges 30 years ago are similar. We don't think they're similar at all. We can't get into the facts of this case because the case will be tried soon."

After several months of delays, Arthur Sumbry's trial is set to begin in Russell County. However, there were some unexpected setbacks. On Friday, the state of Alabama asked for a continuance in the case because quote: "Credible evidence has come to the prosecutor's attention that a member of the jury pool was approached by Sumbry and had direct contact with him." The motion also alleges that Sumbry showed the person evidence and tried to persuade them.

Not long after that motion was filed, Arthur Sumbry Sr. turned himself in to the Russell County Sheriff's Office yet again, charged with perjury, and intimidation of a juror, along with another misdemeanor charge.

Arthur Sumbry bonded out of the Russell County Jail Friday. In light of those new charges, the judge has delayed Sumbry's trial, yet again.
