Michael Registe's case set to appear before Supreme Court of Georgia

COLUMBUS, GA (WTVM) -

Michael Registe was one of America's Most Wanted.  He is accused of killing Columbus State University students Randy Newton Jr. and Bryan Kilgore in 2007.

Registe was captured in St. Marteen and returned to Columbus in 2009. Family members of both victims spoke out when Registe was in custody.

"I do forgive him. I have to have forgiveness in my heart in order to see my son again, to join him again so I cannot hold this hate in my heart because it's tearing me up enough," said Judy Newton, Randy Newton's Mother.

"The only thing I would say is I hope they put away where you can't harm anybody else because I certainly don't want any other families or anybody else to have to go through the pain and the suffering these two families have gone through," said Guy Kilgore, Bryan Kilgore's Father.

On Monday, his case will appear before the Supreme Court of Georgia.

Registe and his attorneys are appealing a ruling by a Muscogee County court denying to suppress cell phone records when the case goes to trial.    

The records were for a phone that police say belonged to a person who was one of the last people to have contact with the victims.  Officials say the cell phone with the number was later found at Registe's apartment.

Defense attorneys say Columbus Police failed to obtain any judicial approval before requesting the records and violated Registe's expectation of privacy.

Prosecutors argue that the trial court properly found that Registe has no standing to claim his fourth amendment rights were violated and police were later able to obtain a court order for the cell phone records.
