COLUMBUS, GA (WTVM) -
A Columbus teen is accused of a horrific crime and now sits in jail waiting for his day in court.
The teen accused of this heinous crime is 15-year-old Quitearn Sumbry. He's a tenth grader with an extensive criminal record.
Just in Muscogee County, violations date back to early 2010. The violations include terroristic threats, auto theft, and carrying a weapon on state property; these are just a few of the charges he's faced over the years.
So far, the only punishment Sumbry has gotten is probation and fines. The latest alleged offense is the rape of a Columbus woman early Saturday morning.
It allegedly happened in her home at Booker T. Washington apartments on 5th Avenue between 3 a.m. and 7 a.m. Saturday morning. We're told Sumbry dragged the 20 year-old mother of two up a flight of stairs, beat her, and then raped her.
The relationship between Sumbry and the victim is still unknown and we're unsure if the children were there when this happened.
Sumbry is being charged as an adult under senate bill 440. The bill states that any youth age 13 to 17 that commit any of seven offenses including murder, rape, armed robbery aggravated child molestation, aggravated sodomy, aggravated sexual battery and voluntary manslaughter can be charged as an adult.
If convicted, senate bill 441 goes into effect and the sentence is a minimum 10 years without the possibility of parole.
We also found out he's currently on probation in Phenix City.
We're told the teen did put up a struggle at the police station and had to be shackled. Sumbry is scheduled to be in Recorder's Court Tuesday at 2 p.m.; he's being charged with rape, battery, false imprisonment and giving a false name.
