A court has rejected Maricopa County Sheriff Joe Arpaio's request to reconsider its ruling that criticized jail officers' decision to force pink underwear onto a mentally ill inmate who erroneously believed his jailers were trying to rape him.

A three-judge panel of the 9th Circuit Court of Appeals on Friday denied Arpaio's request to have a larger panel of justices reconsider the court's March decision.

The court threw out a 2010 jury verdict in favor of Arpaio's office and ordered a new trial in a lawsuit brought by the estate of inmate Eric Vogel.

The estate's attorney has said the officers didn't sexually assault Vogel when he was brought to jail in November 2001 for assaulting an officer, but that Vogel thought he was being raped.
