TUCSON, AZ (AP) -

A judge has declared a mistrial in a first-degree murder case in Tucson.

Pima County prosecutors say attorneys in the Manuel Jesus Pesqueira case received information that jurors had violated their oath not to discuss their case prior to deliberations.

The Arizona Daily Star says a new jury will be selected in the case on Jan. 29.

The 28-year-old Pesqueira is accused of being one of two men who broke into a Tucson apartment allegedly seeking drugs and money on June 29, 2011.

Authorities say one of the apartment's occupants -- 25-year-old Leonardo Cota-Leyva -- was fatally shot in the head.
