Bid to revive lawsuit over 'Day of Prayer' fails

An Arizona appeals court has upheld a ruling that dismissed a lawsuit challenging Gov. Jan Brewer's proclamations that declared a state "day of prayer."

The Arizona Court of Appeals ruled Tuesday that Wisconsin-based Freedom From Religion Foundation failed to show it had standing to file the lawsuit and didn't allege any harm done to the group.

The foundation claimed the proclamations violate a constitutional prohibition against government establishment of religion

A Maricopa County Superior Court judge dismissed the lawsuit in August.

The group appealed that decision in a bid to revive its lawsuit.

The foundation also filed a challenge to the proclamations in December 2011, but that case was later dismissed.

Brewer applauded the appeals court's ruling and characterized the lawsuit as a needless challenge to an American custom.
