State Representative Patricia Todd (D-Birmingham), Alabama's first openly gay elected official, is taking steps to make the state welcome gay marriage by challenging the current ban on the unions.

Todd and her partner have intentions to sue the State of Alabama for discrimination because same-sex couples are not granted the same marriage rights as straight couples.

"I know it's going to be an uphill battle," says Todd. "I know a lot of things are going to be said about me, but that's okay. It's not just about me. It's the thousands of other people in the state who have waited so long for justice and equality."

Todd also guaranteed equal rights all over the country in the next five years.

Todd and her partner intend to elope in another state sometime in the near future.
