BATON ROUGE, LA (WAFB) -

A motion's hearing for the man accused of hitting two bicyclists last year, killing one of them, is scheduled to happen Tuesday after it was postponed a few months ago.

The hearing for Joseph Branch was originally scheduled for April 4, but it was delayed.

The Baton Rouge Police Department said Branch had a blood-alcohol level nearly four times the legal limit when he hit and killed Nathan Crowson, 30, and injured Daniel Morris in January 2012.

Branch is charged with vehicular homicide, negligent injury and second offense DWI. He has pleaded not guilty to all charges.

BRPD reported Branch's BAC was .307 percent after the crash. Investigators said Crowson and Morris were riding bikes in the 6100 block of Perkins Road when they were hit from behind by a vehicle.

Crowson was pronounced dead at the scene. Morris was in the hospital for nearly a month due to the injuries he suffered in the crash.
