PHOENIX (CBS5) -

A judge has scheduled another pretrial conference for the man charged in the hit-and-run death of a Phoenix police officer.

Jesus Cabrera-Molina appeared in court Friday for his first pre-trial conference and a second hearing was set for Aug. 28.

Cabrera-Molina is charged with manslaughter and leaving the scene of an accident after investigators said he was driving an SUV that hit and killed Officer Daryl Raetz on May 19.

Raetz and his partner had stopped a driver on suspicion of driving under the influence and were still on the side of the road near 51st Avenue and Cambridge when Molina allegedly sped through the scene.

Raetz, a six-year police veteran, later died in a hospital.

Police investigators matched pieces of the vehicle from the crime scene with parts that were missing from Cabrera-Molina's SUV.

Court documents show that Cabrera-Molina told police he was drinking and doing cocaine hours before the accident. But Cabrera-Molina insisted he was at home asleep at the time of the crash.

Court paperwork said Cabrera-Molina was caught on surveillance video driving his SUV without damage just before the deadly crash.

The day after Raetz's death, Immigration and Customs Enforcement Officials said Cabrera-Molina was not in the country legally and issued the following statement:

"In March 2012, ICE placed Mr. Cabrera-Molina in removal proceedings and detained him following his incarceration in the Maricopa County Jail on a charge unrelated to this most recent arrest. Mr. Cabrera-Molina was ordered released from ICE custody in May 2012 after he posted the $5,000 bond granted by an immigration judge with the Department of Justice's Executive Office of Immigration Review. His removal proceedings remain pending at this time. In 2011 Mr. Cabrera-Molina was repatriated to Mexico."

CBS 5 News research revealed Cabrera-Molina had other encounters with police. Since 2006, Cabrera-Molina was arrested twice. He was charged with DUI in 2009 and providing liquor to a minor in 2012.
