A Georgia man is now in custody after a fair ride injured five people. The accident happened on Thursday, October 24 at the North Carolina State Fair in Raleigh, North Carolina.

Wake County Sheriff Donnie Harrison says the investigation into the ride accident has led to the arrest of 46 year old Timothy Dwayne Tutterrow of Quitman, Georgia. Tutterrow was charged with three felony counts of assault with a deadly weapon inflicting serious bodily injury.

Tutterrow is employed by an independent ride contractor. According to witnesses, the ride "The Vortex" had stopped and riders were getting off when the ride started back up again.

"After inspection of the ride, we determined that it had been tampered with and critical safety devices were compromised," Harrison said.

Three people are still in the hospital.
