SHELBY COUNTY, TN -

(WMC-TV) – A 40-year-old man is in custody and his girlfriend is dead after he said they got into an argument and his gun went off during a struggle.

When deputies responded to a shooting call at 3886 Inverness Drive, they found Tierria Sims dead on the sidewalk from a gunshot wound.

Sims' boyfriend, Xavier Becton, called Shelby County Sheriff's Office from a nearby Kentucky Fried Chicken parking lot to tell them that his gun went off during an argument with the victim.

According to the affidavit of complaint, deputies found a loaded gun in Becton's pocket when they took him into custody.

Detectives on the scene where Sims was shot found a witness who claims to have heard a woman screaming, "No! No! Please don't!" before the gun went off.

Becton is charged with second degree murder.

Sims' family says she was a loving daughter, sister, and aunt.

"Beautiful, magnificent, loving, caring," said Sims' nephew, Aaron Bailey. "She was all that you could have asked for in an aunt ... It's painful, it's painful. It hurts. It just hurts so bad."

Sims' family told Action News 5's Justin Hanson that she broke up with Becton about four months ago.

"He was more of an if I can't have you then nobody can have you type person. I always told him to leave her alone," said Bailey. "If she's done with you, you be done with her and move on."

Becton refused to make a statement to deputies after he was arrested.
