BIRMINGHAM, AL (WBRC) -

A federal lawsuit claims an Alabama jail guard repeatedly raped an inmate.

The suit claims a female warden was told about the abuse and the warden allegedly said there was nothing she could do about it.

The woman suing is Olivia Osborne. She was an inmate at the Birmingham Work Release Center in 2011. She says the rapes started that year.

Osborne is suing the guard, Vincent Cheatham, warden Shirley Smith, and the Alabama Corrections Commissioner Kim Thomas. She also claims the warden put her on birth control. FOX6 is seeking clarification on that allegation.

We have also asked the Alabama Prison System for comment on the suit. A spokesman says it is their policy not to comment on pending litigation.

Osborne is seeking compensatory and punitive damages for assault and battery, negligence, intentional infliction of emotional distress, false imprisonment, sexual harassment and deliberate indifference.

She is represented by Leroy Maxwell Jr. of the Revill Law Firm in Birmingham.
