Child sex suspect claims twin is perpetrator

HUNTSVILLE, AL (WAFF) -

A Madison County man facing sexual abuse charges in multiple states says his twin brother committed some of the crimes. Aaron Lucas is accused of targeting children in Colorado, Texas, and in Madison County

One year ago, Colorado authorities charged Lucas with crimes including aggravated sexual assault on a child and kidnapping. Colorado authorities said there are more than a dozen alleged victims. DNA evidence then linked Lucas to a similar crime in Madison and in Texas. But according to court documents, Lucas's attorney says his client has an identical twin brother named Brian, and that the DNA is his twin brother's and not Aaron's.

We reached out to the Madison Police about the claims. An investigator said Brian Lucas had never been a suspect, they're not considering him a suspect now, and Aaron Lucas is the one they believe is responsible for the alleged crime.

According to WAFF legal analyst Mark McDaniel, this kind of defense is what you hear about in law school but he's never seen it in action during his 37 years of practicing and defending clients. The court documents also claim another man in Colorado was arrested around the same time as Lucas on similar charges. The documents allege that man looks like the description police gave out of the sexual predator Lucas is accused of being. 

"If he starts saying it is my evil twin or it's this person that looks like him you're getting into a situation where juries don't like that," said McDaniel. "You either got this defense or you don't have this defense."

Alabama authorities acknowledged it could take years to get Lucas back in an Alabama court room because he has to settle his Colorado legal obligations first.
