Mandatory fine challenged in Yavapai County

PRESCOTT, AZ (AP) -

Lawyers for six defendants in Yavapai County criminal cases are challenging county prosecutors' insistence that all plea agreements include a minimum fine of $750 plus an 83 percent surcharge.

The lawyers for the defendants contend the mandatory fines are unfair to indigents and aren't itemized to reflect actual costs though they're supposedly intended to make defendants pay for their prosecutions.

The County Attorney's Office says the requirement for the minimum fine is just part of the punishment for those who commit felonies.

The Daily Courier reports that Superior Court Judge Tina Ainley did not rule immediately on the challenge. She held a hearing on the issue Wednesday.
