MONTGOMERY, AL (WSFA) -

The firm that performed an audit of Alabama State University is firing back at ASU's lawsuit against them.

Forensic Strategic Solutions has filed a motion to quash ASU's lawsuit, which was filed in a California court.

FSS contends the suit has no basis, and Alabama would be a more appropriate forum. FSS argues that ASU "must have strategic reasons for suing in California." The motion asks the court to find that it doesn't maintain jurisdiction over FSS and quash the lawsuit.

"ASU is using this Court to manufacture a conflict between itself and FSS in an effort to chill FSS's ability to perform its work for the Governor of Alabama," the motion states. "This Court should not take kindly to ASU's use of this judicial forum to strategically benefit itself and to garner media attention (all of which was sought in Alabama and not California)."

The preliminary audit released in October pointed out conflicts of interest and financial mismanagement at ASU. FSS also said ASU's procedures prevented the firm from finding fraudulent activity.

ASU's lawsuit accuses FSS of issuing a "false and misleading" report meant to interfere with ASU's economic status.
