Fatal shooting in Wylam ruled justifiable

BIRMINGHAM, AL (WBRC) -

A shooting that fatally injured a Birmingham man has been ruled justified by the District Attorney's Office.

34-year-old Harold Eugene Davis was killed on March 1 around 7 p.m. in the 900 block of Erie Street in Wylam. Investigators were able to identify a vehicle of a interest after the shooting and found the driver was arrested by Jefferson County deputies on a robbery charge the morning after the homicide.

The driver, Demarques King, admitted to being at the scene and said Henry Toles (a.k.a "Ra Ra") was riding with him.

Toles came to the Birmingham police administrative building on March 5 and voluntarily spoke with investigators. He admitted to shooting the victim, but claimed self-defense. Investigators found several threats had been made earlier in the day of the shooting by the victim.

Two hand guns were recovered from the scene of the shooting as well as the video surveillance from the convenience store. Several witnesses corroborated with the statements made by Toles.

The case was presented to the Jefferson County District Attorney's Office on Thursday. The DA's Office advised that there would be no charges against the shooter and the shooting would be ruled as justifiable.
