TOLEDO, OH (Toledo News Now) -

A Toledo man is facing animal cruelty charges after Toledo Police say he shot and killed his neighbor's dog.

The dog's owner and these court documents say the dog was chained up and in the yard when she was shot and killed.

Police arrested 36-year-old Christopher Lamar Bethany, who lives next door, for the shooting.

The dog's owner did not want to be identified, but did say she thinks she knows why Bethany shot her dog Nakita. She says she thinks Bethany's dog was wandering without a leash and came into her yard. She says Nakita may have attacked and fatally injured that dog.

"Our neighbors were upset about their dog passing away because they got attacked because it was in somebody else's yard and they lost their dog too, I understand that. But at the same time you're grown adults you're responsible for your dog being safe. My dog was safe in her yard. That's what we thought," said Nakita's owner.

The woman says she plans to put a fence around her house so nothing like this happens again.
