MONTGOMERY, AL (WSFA) -

The family of a local rapper shot and killed at a Montgomery nightclub is now suing.

WSFA 12 News has obtained a copy of the lawsuit against the City of Montgomery and Nicole Bankhead, the owner of Centennial Hill Bar & Grill, formerly known as the Rose Supper Club.

Glenn Thomas, whose stage name was Doe B, was fatally shot on Dec. 23 at Centennial Hill. Two others were killed and five others were injured in the shooting.

The lawsuit alleges that the city had a duty to monitor Centennial Hill and make sure it complied with conditions to keep its liquor license. It further alleges that the city knew about the previous incidents at Centennial Hill but still granted a liquor license.

"Without approval of its license to serve alcoholic beverages, Centennial Hill Bar & Grill would not have been in operation and open for business during December 2013," according to the Law Office of Dwayne Brown.

Following the shooting, Montgomery Mayor Todd Strange ordered the business to be closed saying it is "an imminent threat to public safety."
