LOWNDES CO., AL (WSFA) -

It was standing room only in Hayneville's municipal court: a typical arraignment docket, that was anything but.  Lowndes County Superintendent, Dr. Daniel Boyd was called by the judge first to enter not guilty pleas for 243 counts of reckless endangerment. The charges were handed down after a school janitor admitted to fondling a female student, 6 months after the school system's internal investigation returned inconclusive evidence. 

Boyd's not guilty pleas were never heard, due to unanticipated news by the Hayneville Police Chief, Kelvin Mitchell, a lightening rod of controversy in this case.  The first bombshell: 135 charges had been dropped due to the charges being filed outside the police jurisdiction, representing the female students in one of the schools the janitor worked.  But no one expected Mitchell to then report a case had also been filed against Boyd in District Court.  Boyd's attorney Hank Sanders says he was floored, "I was shocked, that really caught me off guard".  WSFA 12 News later confirmed this wasn't true.  Mitchell also alleged Lowndes County District Attorney Charlotte Tessmer initially agreed to prosecute a case against Boyd, which she denies, reporting her office has no intentions of seeking charges against the superintendent.

The defense team agreed not to go forward with the arraignment due to the confusion over the number of counts, and allegations of a district court case.  The municipal judge chose to recuse himself due to possible conflicts of interest.  The mayor reportedly will appoint a new judge to hear this case.
