Opelika police officer not indicted for shooting Airman

The Opelika police officer involved in the shooting of an Airman earlier this year will not be indicted.

Officer Phillip Hancock was charged in March 2014 with shooting Airman Michael Davidson.

In an official response release Monday May 12 to the Grand Jury's report, officials said that Hancock relied on a split-second decision to shoot Davidson.

"A police officer is justified in using deadly physical force upon another person when he believes it is reasonably necessary to defend himself or a third party from what he reasonably believes to be the use or imminent use of deadly physical force," the statement read. "The grand jury decided that there was insufficient evidence to charge Officer Phillip Hancock with a crime.  Thus, Phillip Hancock will not face criminal charges in connection with the shooting of Michael Davidson.  We believe his decision to use deadly force was reasonable and legally justified under the facts and circumstances of this case."

On March 6, 2014 Hancock was called to Interstate 85 to pull over an erratic driver around 7 p.m. near Exit 62.

At some point during this stop, 20-year-old Michael Davidson of Texas was shot by Officer Hancock and transported to the hospital. Davidson is an Airman and was on his way to the Seymour Johnson Air Force Base in North Carolina when the incident occurred.
