Deputies: Tamassee homeowner shoots intruder, no charges filed

WALHALLA, SC (FOX Carolina) -

Oconee County deputies said a shooting in the northern part of the county on Tuesday was self-defense.

Deputies said they responded to a report of a shooting at 4:15 p.m. on Burrell Drive in Tamassee.

When they arrived, they found one gunshot victim, who was treated by EMS and flown by helicopter to Greenville Hospital Systems. 

Captain Travis Tilson said investigators have determined the victim, 41-year-old Bradley Payne, of Walhalla, was standing outside the home threatening the homeowner prior to the shooting.

Tilson said the homeowner retrieved a pistol and yelled for Payne to not enter the home.

Payne then jerked open the screen door and entered the home, Tilson said.

He said the homeowner shot Payne as he entered, striking him in the hip. The homeowner then called 911 and waited for deputies to arrive.

"No criminal charges will be filed against the individual who shot Mr. Payne. South Carolina law is very clear in stating a man's home is his castle. A homeowner has the right to protect themselves if they fear their life is in imminent danger," said Sheriff Mike Crenshaw in a release.

Tilson said investigators are looking into if charges will be pressed against Payne for entering the home unlawfully.
