Police: Dashcam video of Opelika officer involved shooting will not be released

OPELIKA, AL (WTVM) -

The dash cam video from a March 2014 officer involved shooting will not be released, according to a press release from the Opelika Police Department.

On March 6, 2014, Airman Michael Davidson was passing through Opelika on his way to his next assignment in North Carolina. His attorney said Davidson had just exited his car on I-85 to check on another driver who was involved in a minor accident. Officer Phillip Hancock was called to I-85 to pull over an erratic driver, and at some point he fired his service weapon, severely injuring Davidson.

The Alabama Bureau of Investigation (ABI) conducted the investigation.

Police have since said they would release the dash cam video as soon as possible, but they have now been instructed to do otherwise.

Opelika Chief of Police John H. McEachern, III said, "The ABI report was delivered to the Opelika Police Department Aug. 1, 2014 and received by the Chief of Police Aug. 4. The City's attorneys have advised it is privileged pursuant to state law. Based on that, and the potential impact the release of the ABI report and video could have on litigation, I have been instructed not to release either."

Police say there will be no further comments about the matter.
