OPELIKA, AL (WTVM) - Court documents revealed new information in this case concerning the Opelika teen that was shot.

Documents indicated that the victim and the suspect were watching a movie, when the teen suspect began to handle the gun that he thought was unloaded.

Police say a 16-year-old Opelika teen remains in critical condition and was expected to have surgery again on Thursday. This was after the teen was allegedly shot by a teenage friend.

Investigators say it appears the teen, the suspect, Devontae Henderson and a group of friends were hanging out inside a home on South Antioch Circle. Around 1:25 p.m., police say Henderson's reckless behavior led to the gun firing.

“The facts and circumstances so far point to this being a reckless use of force without it being intentional,” Capt. Shane Healey with Opelika police stated.

Police say Henderson faces assault charges, but not attempted murder, because they do not believe he intended to shoot his friend.

The gun was allegedly stolen and recovered by police at the scene after someone apparently hid it in a nearby meter box.

“It's just unfortunate, you have two teens, one who is in the hospital with a serious wound, and the other who is in jail,” Healey said.

This case will be presented to a grand jury, and the charges could be upgraded.
