COLUMBUS, GA (WTVM) - Saint Francis Hospital has filed a motion to dismiss the lawsuit filed against it by a former perspective buyer, Community Health Services.
According to court documents filed by CHS in the initial suit, they are suing on three counts: fraud, breach of contract and litigation costs, and claiming Saint Francis lied during a meeting, not informing them HUD audit.

The motion claims: "CHSPSC's claim that St. Francis's breached the Letter Agreement's exclusivity provision fails because CHSPSC offers nothing more than bare legal conclusions, which do not stand up to a Rule 12(b)(6) motion to dismiss."
CHS consider the audit a red flag in the acquisition. They are seeking $5 million in damages. Saint Francis is seeking to have the lawsuit dismissed claiming the suit boils down to three "poorly defined and insufficiently pled allegations."
Another company is in the process of buying Saint Francis.
