Markale Hart indicted for murder by Lee Co. Grand Jury

A Lee County Grand Jury has indicted Markale Hart on murder charges in connection to the alleged killing of an Auburn University football player. 

Hart is accused of killing Jakell Mitchell, a freshman on the Auburn football team, in December, 2014.

Mitchell was shot and killed at the Tiger Lodge apartment complex on Long Leaf Drive, which is the same complex where Desmonte Leonard shot and killed three men and wounded three others at a party in 2012.

A detective with the Auburn Police Department testified during the preliminary hearing that Mitchell was in a verbal argument with Hart’s cousin, Tyrone Rowe. According to Hart’s attorney, Mitchell and Rowe were arguing over a woman they had both dated.

Detectives testified that both Hart and Mitchell were armed with weapons and exchanged gunfire. Based on witnesses, police believe Hart fired the first shot and that Mitchell fired back as he fell to the ground.

Hart’s attorney says Mitchell fired first and his client fired in self defense. 

Hart was on probation for a burglary conviction out of Tallapoosa County when he allegedly shot and killed Mitchell.
