COLUMBUS, GA (WTVM) – The city of Columbus claims victory Tuesday in an ongoing legal battle.

The court found no merit in Marshal Greg Countryman and Municipal Court Clerk Vivian

Creighton Bishop's lawsuit against the city over inadequate operating budgets for 2015.

Their attorney, Charlie Miller, in a statement said:

"We are happy the Court denied the City's frivolous claim that our clients had to pay money back from their own budgets. We respectfully disagree with the Court's ruling as it pertains to section 8-105 of the City Charter as it renders such section meaningless. The ruling is troubling in light of the prior denial of the City's Motions to Dismiss.  As a result, we will be weighing our appeal options over the next thirty days."

Mayor Teresa Tomlinson called the lawsuit reckless and irresponsible.
