No Charges Filed in Alleged Nursing Home Rape Case

OPELIKA, Ala. (WXTX) - No charges will be filed in an alleged rape at the Care Center nursing home in Opelika.  Police say a care center employee reported a 71-year old resident had been raped on Thursday, June 12th.

Police identified a 65-year old, also a resident, as their possible suspect. However, on recommendation by the Lee County District Attorney's Office, charges will not be field because the intent of the suspect can't be proven.

Both the suspect and victim suffer from dementia. The case has been closed by investigators.
